This Testimonial, Media and Content Release Agreement (“Agreement”) governs the submission and use of testimonials, reviews, photographs, videos, audio recordings, social media content, written statements, success stories and other promotional content provided to Olympus Insights Pty Ltd (“Olympus Insights”, “OLi”, “we”, “our” or “us”).
By submitting content to Olympus Insights, you agree to the terms outlined in this Agreement.
This Agreement applies to any content voluntarily submitted to Olympus Insights, including but not limited to:
This Agreement applies whether content is submitted through:
You grant Olympus Insights a perpetual, irrevocable, worldwide, non-exclusive, royalty-free licence to use, reproduce, publish, distribute, display, edit, adapt, modify, translate, create derivative works from and otherwise utilise submitted content.
This permission includes use across:
This licence remains valid indefinitely unless Olympus Insights agrees otherwise in writing.
Where applicable, you grant Olympus Insights permission to use:
for promotional purposes.
Olympus Insights will not publish sensitive personal information without additional consent.
For users under 18 years of age, consent must be provided by a parent or legal guardian.
You acknowledge that Olympus Insights may:
Olympus Insights agrees not to materially misrepresent the meaning or intent of the original submission.
Unless otherwise agreed in writing, submission of content does not entitle you to any compensation.
Where Olympus Insights offers incentives, rewards, prizes or payments for content submissions, those incentives represent full and final compensation for the content submitted.
No ongoing royalties, commissions, residual payments or future compensation will be payable.
You retain ownership of any original content you submit.
However, by submitting content, you grant Olympus Insights the rights described in this Agreement.
You acknowledge that Olympus Insights may continue using content already incorporated into marketing materials, campaigns, publications, presentations or media, even if you later request removal.
By submitting content, you represent and warrant that:
You agree to indemnify Olympus Insights against claims arising from breaches of these representations.
Where content relates to a person under 18 years of age:
Personal information collected under this Agreement will be handled in accordance with the OLi AI Tutor Privacy Policy.

Olympus Insights will consider reasonable requests to remove future uses of submitted content.
However, you acknowledge that content already published, distributed, printed, broadcast or incorporated into existing materials may not be capable of complete removal.
Olympus Insights reserves the right to determine whether removal is reasonably practicable.
To the maximum extent permitted by law, Olympus Insights shall not be liable for any indirect, incidental, consequential or special loss arising from the use of submitted content in accordance with this Agreement.
Nothing in this Agreement excludes, restricts or modifies any rights that cannot legally be excluded, restricted or modified under Australian Consumer Law.
This Agreement is governed by the laws of Western Australia.
Any dispute arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of Western Australia.
